Rules and standards that govern how all Users may access and use the Hab Jobs platform. By using the Platform you agree to comply with this Policy; failure to comply may result in suspension, account termination, or referral to law-enforcement authorities.
This Acceptable Use Policy ("AUP", "Policy") sets out the rules and standards that govern how all Users may access and use the Hab Jobs platform at https://www.habposlovi.com/ ("Platform"), operated by Avenor Holdings LLC ("Company", "we", "us", "our").
This Policy applies to all Users of the Platform, including Candidates, Employers, visitors, and any other individuals or entities that access any part of the Platform in any capacity. It supplements and is incorporated into the general Terms of Service and, where applicable, the Employer Terms and Conditions.
The purpose of this Policy is to protect the integrity, security, and quality of the Platform; to protect the rights and safety of all Users; and to ensure that the Platform is used only for its intended purpose as a lawful, professional employment marketplace.
By accessing or using the Platform in any way, you agree to comply with this Policy. Failure to comply may result in immediate suspension or permanent termination of your account, removal of content, and where warranted, referral to law enforcement authorities.
1. Scope of This Policy
This Policy applies to all activities conducted on or through the Platform, including but not limited to:
- Creating or managing a User account
- Posting, editing, or managing job listings
- Submitting job applications or candidate profiles
- Using the Platform's messaging or communication features
- Accessing or searching candidate or employer databases
- Interacting with any Platform feature, tool, or interface
- Accessing the Platform via API, automated script, or third-party integration
- Any activity that originates from or is directed at the Platform's systems or infrastructure
This Policy also applies to conduct that occurs outside the Platform but that is directly connected to Platform use, such as using contact information obtained through the Platform to engage in prohibited conduct via external channels.
2. Prohibited Conduct — All Users
2.1 Illegal and Harmful Activity
No User may use the Platform to engage in, facilitate, or promote any activity that is unlawful under applicable local, national, or international law. This includes, without limitation:
- Engaging in any form of fraud, including identity fraud, payment fraud, or employment fraud
- Submitting forged, falsified, or counterfeit documents, credentials, or identification
- Facilitating human trafficking, forced labor, child labor, or any form of modern slavery
- Engaging in money laundering, terrorist financing, or any activity related to the proceeds of crime
- Violating any applicable anti-corruption, anti-bribery, or sanctions laws
- Accessing or using the Platform from a jurisdiction where doing so is prohibited by applicable law
2.2 Unauthorized Access and Technical Attacks
Users may not attempt to gain unauthorized access to any part of the Platform or to any data, systems, or networks connected to it. Prohibited conduct in this category includes:
- Attempting to bypass, circumvent, or defeat authentication mechanisms, access controls, or security features
- Probing, scanning, or testing the vulnerability of the Platform's systems or networks without the Company's express written permission
- Introducing, transmitting, or distributing malware, viruses, ransomware, trojans, worms, spyware, adware, or any other malicious code
- Conducting or facilitating denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against the Platform or any connected infrastructure
- Attempting to intercept, monitor, or tamper with data transmissions on the Platform
- Exploiting any software vulnerability, bug, or security flaw in the Platform, whether discovered intentionally or accidentally, without immediately reporting it to the Company at info@habposlovi.com
- Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of any component of the Platform
2.3 Automated Access and Data Scraping
The use of automated tools to access or extract data from the Platform without the Company's express written permission is strictly prohibited. This includes:
- Using bots, crawlers, spiders, scrapers, or other automated agents to access, index, or extract any content or data from the Platform
- Using screen-scraping, data mining, or harvesting tools to collect job listings, candidate profiles, employer data, or any other Platform content
- Circumventing any rate limiting, CAPTCHA, or anti-scraping measures implemented by the Platform
- Accessing the Platform through unauthorized API calls or by simulating browser behavior to extract data at scale
- Aggregating or republishing Platform content on third-party websites or platforms without authorization
Authorized integrations must be established through the Company's official API program, if available, and are subject to separate terms and conditions.
2.4 Deceptive and Fraudulent Conduct
Users may not engage in any conduct that is deceptive, misleading, or designed to manipulate other Users or the Company. This includes:
- Creating fake, duplicate, or fictitious accounts for any purpose
- Impersonating any person, company, organization, or representative, including Company staff, other employers, or other candidates
- Misrepresenting your identity, qualifications, employment history, business registration status, or authority to act on behalf of an entity
- Posting or submitting content that you know to be false, misleading, or materially inaccurate
- Artificially inflating the visibility, rating, or engagement metrics of any listing, profile, or account
- Creating or managing accounts on behalf of others without their knowledge or consent
- Using the Platform to conduct phishing attacks, social engineering, or any scheme designed to deceive other Users into disclosing credentials or sensitive information
2.5 Harassment, Discrimination, and Harmful Content
The Platform must be a safe and respectful environment for all Users. The following conduct is strictly prohibited:
- Harassing, threatening, intimidating, stalking, or abusing any other User, whether through the Platform's messaging system or through external channels using contact details obtained via the Platform
- Publishing or transmitting content that is defamatory, obscene, sexually explicit, or designed to humiliate or degrade any individual
- Discriminating against or expressing hatred toward any individual or group on the basis of race, color, gender, gender identity or expression, age, religion, national origin, disability, sexual orientation, pregnancy, marital status, or any other protected characteristic
- Publishing content that promotes, glorifies, or facilitates violence, self-harm, or harm to others
- Doxxing or publicly disclosing the private personal information of any individual without their consent
2.6 Spam and Unsolicited Communications
Users may not use the Platform's communication features to send unsolicited or bulk communications. Prohibited conduct includes:
- Sending spam, chain messages, or unsolicited commercial communications to other Users
- Using the Platform's messaging system to solicit Users for products, services, or opportunities unrelated to the employment purpose of the Platform
- Adding Users to external mailing lists or marketing lists without their explicit, informed consent
- Using contact details obtained through the Platform to send unsolicited communications outside the Platform
2.7 Intellectual Property Violations
Users may not submit, upload, or distribute content that infringes the intellectual property rights of any third party. This includes:
- Uploading copyrighted text, images, logos, or other materials without authorization from the rights holder
- Using trademarks or brand names belonging to other companies in a manner likely to cause confusion or imply affiliation
- Reproducing, adapting, or distributing Platform content, including job listing databases or candidate search results, without the Company's written permission
- Submitting plagiarized content in job listings, company descriptions, or candidate profiles
2.8 Platform Integrity
Users may not engage in any conduct that interferes with the proper functioning of the Platform or that degrades the experience of other Users. This includes:
- Overloading Platform infrastructure by sending an excessive volume of requests in a short period
- Manipulating search rankings, recommendation algorithms, or any other Platform feature through artificial means
- Posting duplicate listings or creating multiple listings for the same role to gain disproportionate visibility
- Using the Platform in a manner inconsistent with its intended purpose as an employment marketplace
3. Additional Obligations for Employers
In addition to the general prohibitions set out in Section 2, Employers are subject to the following additional requirements:
- All job listings must represent genuine employment opportunities and must comply with applicable employment law in the relevant jurisdiction, including non-discrimination requirements
- Employers must not post listings designed to collect candidate personal data for purposes other than the stated hiring opportunity
- Employers must not post listings that advertise roles requiring candidates to pay fees or purchase goods as a condition of employment
- Employers must process candidate personal data received through the Platform in compliance with applicable data protection law, including the GDPR where applicable, as further described in the Employer Terms and Conditions
- Employers must promptly remove listings for roles that have been filled or withdrawn
- Employers who use the Platform on behalf of a client employer must disclose the intermediary relationship in the listing
Violations of employer-specific obligations are governed in detail by the Employer Terms and Conditions, which impose additional liability and compliance standards on Employer accounts.
4. Additional Obligations for Candidates
In addition to the general prohibitions in Section 2, Candidates are subject to the following requirements:
- All information submitted in a Candidate profile, CV, cover letter, or application must be truthful, accurate, and not misleading
- Candidates must not fabricate employment history, academic credentials, certifications, references, or any other professional information
- Candidates must not submit applications or documents on behalf of another person without that person's knowledge and explicit consent
- Candidates must not use the Platform to approach employers for purposes other than legitimate job applications
- Candidates must not use the Platform's features to gather employer contact details for mass or unsolicited outreach
5. Content Standards
5.1 General Content Requirements
All content submitted to the Platform by any User must:
- Be accurate, truthful, and not misleading
- Comply with all applicable laws and regulations
- Not infringe the intellectual property, privacy, or other rights of any third party
- Be appropriate for a professional employment marketplace
- Be in a language that is consistent with the Platform's supported languages
5.2 Prohibited Content
The following types of content are prohibited on the Platform regardless of context:
- Content that promotes, incites, or glorifies violence, terrorism, or extremist ideology
- Content that exploits, sexualizes, or endangers minors in any way
- Content that constitutes hate speech, including content that dehumanizes individuals based on protected characteristics
- Content that contains personally identifiable information about third parties submitted without their consent
- Content that constitutes or facilitates unauthorized collection of personal data
- Content that includes malicious links, executable files, or code designed to harm systems or extract data
- Content that has been generated or substantially modified by artificial intelligence for the purpose of deceiving other Users about the nature or origin of the content, where such deception is material to a hiring decision
5.3 Language and Format
Content must be submitted in a legible and professional format. The Company reserves the right to remove or refuse to publish content that is illegible, incomprehensible, or formatted in a manner that renders it unsuitable for the Platform.
6. Reporting Violations
The Company encourages all Users to report conduct or content that they believe violates this Policy. Reports can be submitted by:
- Emailing info@habposlovi.com with a description of the suspected violation, including relevant usernames, listing URLs, or message content where applicable
- Using any in-platform reporting feature made available on the relevant listing or profile page
Reports will be reviewed in good faith. The Company cannot guarantee any specific response time or outcome in respect of a report but will investigate material concerns that are brought to its attention.
The Company does not retaliate against Users who make good-faith reports of suspected violations. Users who make reports that are knowingly false or designed to harass another User may themselves be subject to enforcement action.
7. Enforcement and Consequences
7.1 Enforcement Actions
The Company reserves the right, at its sole discretion and without prior notice, to take any of the following enforcement actions in response to a violation of this Policy:
- Issue a formal warning to the User
- Remove or modify content that violates this Policy
- Temporarily restrict access to specific Platform features
- Suspend the User's account pending investigation
- Permanently terminate the User's account
- Disclose information about the User to law enforcement or regulatory authorities where required by law or where the Company has a good-faith belief that the User has engaged in criminal conduct
- Pursue civil legal action against the User for damages, injunctive relief, or both
7.2 Investigation Process
When the Company receives a report or independently identifies a potential violation of this Policy, it may:
- Request additional information from the User under investigation
- Temporarily restrict the User's access to relevant features during the investigation
- Review account history, content submissions, and communication logs to the extent permitted by applicable law
The Company will make reasonable efforts to conduct investigations fairly and in a timely manner, but does not guarantee any specific investigation timeline. The Company's determination with respect to a Policy violation is final, subject to the appeals process described below.
7.3 Appeals
Users who believe that an enforcement action has been taken against them in error may submit a written appeal to info@habposlovi.com within 14 calendar days of receiving notice of the enforcement action. The appeal must include:
- A clear description of the enforcement action taken
- The User's explanation of why the action was taken in error
- Any supporting evidence the User wishes the Company to consider
The Company will review the appeal and respond within 30 calendar days. The Company's decision on appeal is final. Submitting an appeal does not automatically suspend an enforcement action.
7.4 No Liability for Enforcement Actions
The Company shall not be liable to any User for any loss, damage, or inconvenience caused by enforcement actions taken in good faith under this Policy, including account suspension, content removal, or termination.
8. Security Vulnerabilities
If you discover a security vulnerability, bug, or weakness in the Platform, you agree to report it to the Company promptly and confidentially by emailing info@habposlovi.com. You agree not to exploit any discovered vulnerability, disclose it publicly, or share it with third parties before the Company has had a reasonable opportunity to investigate and remediate it.
The Company will acknowledge receipt of security vulnerability reports within 5 business days and will work in good faith to address confirmed vulnerabilities. The Company does not currently operate a formal bug bounty program, but reserves the right to recognize responsible disclosures at its discretion.
9. Relationship to Other Policies
This Acceptable Use Policy should be read in conjunction with the following documents, all of which are incorporated by reference:
- Terms of Service: The master agreement governing all use of the Platform
- Privacy Policy: Governing the collection and processing of personal data
- Cookie Policy: Governing the use of cookies and tracking technologies
- Employer Terms and Conditions: Additional obligations applicable to Employer accounts
- Refund and Cancellation Policy: Governing payment-related matters
In the event of a conflict between this AUP and the Terms of Service on a matter not specific to acceptable use standards, the Terms of Service shall prevail. In the event of a conflict between this AUP and the Employer Terms and Conditions on an employer-specific matter, the Employer Terms and Conditions shall prevail.
10. Updates to This Policy
The Company reserves the right to update this Policy at any time to reflect changes in law, Platform features, or the Company's operational practices. When material changes are made, the Company will post the revised Policy on the Platform with an updated Effective Date and, for registered Users, provide notice by email. Continued use of the Platform after the effective date of the revised Policy constitutes acceptance.
