Limitations and exclusions of liability applicable to use of the Hab Jobs platform. Read together with the Terms of Service and the other legal documents incorporated by reference.
This Disclaimer sets out the limitations and exclusions of liability applicable to the use of the Hab Jobs platform at https://www.habposlovi.com/ ("Platform"), operated by Avenor Holdings LLC ("Company", "we", "us", "our"). It should be read in conjunction with the Terms of Service, Privacy Policy, and all other legal documents published on the Platform, all of which are incorporated by reference.
By accessing or using the Platform in any capacity, you acknowledge that you have read and understood this Disclaimer and agree to be bound by its terms. If you do not accept the terms of this Disclaimer, you must discontinue use of the Platform immediately.
1. Nature of the Platform
Hab Jobs is an online employment marketplace that connects job seekers ("Candidates") with companies and organizations seeking to fill employment and engagement opportunities ("Employers"). The Company operates as a neutral technology intermediary and facilitates the display of job listings and the submission of applications. The Company is not an employment agency, staffing firm, recruiter, or employer of any kind.
The Company does not participate in any hiring decision, selection process, employment negotiation, or contractual arrangement between a Candidate and an Employer. Any employment relationship, contract of service, contractor agreement, or other engagement that may result from the use of the Platform is formed exclusively between the Candidate and the Employer. The Company is not a party to any such arrangement and accepts no liability in connection with it.
The Company does not act as an agent of any Employer listed on the Platform and does not represent, endorse, or vouch for any Employer's business practices, financial standing, legal compliance, or suitability as an employer.
2. No Guarantee of Employment
The Platform provides a service that facilitates access to job listings and enables Candidates to submit applications. Nothing on the Platform, in its marketing materials, or in any communication from the Company constitutes a representation, warranty, or guarantee that:
- A Candidate will receive a response to any application submitted through the Platform
- A Candidate will be invited to an interview, offered a position, or successfully employed as a result of using the Platform
- A specific number or quality of applications will be received by an Employer in connection with any listing
- A job listing will attract candidates with the qualifications or experience described in the listing
- The use of the Platform will result in any particular employment or business outcome for any User
Employment outcomes depend on numerous factors beyond the Company's control, including the Employer's internal selection processes, the qualifications of individual Candidates, market conditions, and regulatory requirements. The Company accepts no liability for any failure to achieve an employment outcome through the use of the Platform.
3. Accuracy of Job Listings
3.1 Employer Responsibility
All job listings published on the Platform are created, submitted, and managed by Employers. The Company does not author, draft, verify, or independently confirm the accuracy, completeness, or currency of any listing. Each Employer is solely responsible for ensuring that its listings accurately describe the available role, including the position's duties, qualifications, compensation, location, employment type, and application process.
3.2 No Warranty of Accuracy
The Company makes no representation or warranty, express or implied, that any job listing on the Platform is accurate, complete, current, free from error, or representative of an available or genuine employment opportunity. Listings may contain inaccuracies, be outdated, or relate to roles that have already been filled at the time a Candidate views or applies for them.
3.3 Candidate Due Diligence
Candidates are strongly encouraged to independently verify the details of any job listing before submitting an application or taking any action in reliance on listing content. This includes verifying the existence and legitimacy of the Employer, confirming that the role is still available, and ensuring that the stated terms are consistent with what is offered during any subsequent recruitment process.
3.4 Suspicious Listings
While the Company performs a basic verification of Employer accounts prior to activation, this verification does not constitute a guarantee that every listing is legitimate. Candidates who encounter listings that appear fraudulent, misleading, or inconsistent with the standards set out in these documents are encouraged to report them immediately at info@habposlovi.com or by using any in-platform reporting feature. The Company will investigate reports in good faith but cannot guarantee any specific outcome or that all fraudulent listings will be identified before a Candidate interacts with them.
4. Accuracy of Candidate Information
All candidate profiles, CVs, cover letters, and application materials submitted through the Platform are provided by Candidates. The Company does not verify, screen, or independently confirm the accuracy of any information submitted by a Candidate, including stated qualifications, employment history, certifications, references, or professional experience.
Employers are solely responsible for conducting their own verification, background checks, reference checks, and due diligence with respect to any Candidate with whom they engage through the Platform. The Company accepts no liability for any losses, damages, or claims arising from an Employer's reliance on inaccurate, false, or misleading Candidate information.
5. Employer Verification Limitations
The Company performs a basic verification of Employer accounts before allowing job listings to be published. This verification process is designed to reduce the risk of fraudulent or misleading listings but does not constitute a comprehensive due diligence review of the Employer's legal status, financial condition, employment law compliance, or business practices.
Verification does not imply any endorsement, recommendation, or certification of any Employer by the Company. The Company does not guarantee that all verified Employers are who they claim to be, are currently solvent, are authorized to hire in the jurisdictions where they operate, or are in compliance with applicable employment law.
Users who suffer loss or harm as a result of interacting with a fraudulent or non-compliant Employer through the Platform should report the matter to the Company and, where appropriate, to relevant law enforcement or regulatory authorities. The Company will cooperate with legitimate investigations to the extent permitted by applicable law.
6. Third-Party Content and External Links
The Platform may display or link to content, websites, services, or resources provided by third parties, including Employers, external job boards, professional networks, or other third-party platforms. The Company does not control, endorse, or accept responsibility for any third-party content, and the inclusion of any link or reference to a third-party resource does not constitute an endorsement of that resource or its operator.
Access to third-party websites or services linked from the Platform is at your own risk and subject to the terms and conditions and privacy policies of those third parties. The Company is not responsible for the availability, accuracy, or content of any third-party resource, nor for any loss or damage arising from your use of or reliance on such resources.
The Company does not monitor or exercise editorial control over third-party content displayed on or linked from the Platform and cannot guarantee that such content is free from errors, inaccuracies, or offensive material.
7. Platform Availability and Technical Limitations
The Platform is provided on an "as is" and "as available" basis. The Company does not warrant that the Platform will be continuously available, uninterrupted, error-free, or free from technical defects. Access to the Platform may be affected by factors outside the Company's reasonable control, including:
- Scheduled or unscheduled maintenance
- Internet infrastructure outages or disruptions
- Failures of third-party service providers including hosting providers and payment processors
- Cybersecurity incidents, including but not limited to denial-of-service attacks
- Force majeure events as defined in the Terms of Service
The Company will use reasonable commercial efforts to minimize planned downtime, provide advance notice of scheduled maintenance where practicable, and restore Platform availability promptly following any unplanned outage. However, the Company does not guarantee any specific uptime level or service availability metric and shall not be liable for any losses arising from Platform unavailability unless caused by the Company's gross negligence or willful misconduct.
The Platform may not be compatible with all browsers, operating systems, or devices. The Company does not warrant that the Platform will function correctly on all hardware and software configurations. Users are responsible for ensuring that their devices and internet connections are suitable for accessing the Platform.
8. No Professional Advice
Nothing on the Platform constitutes legal, employment, tax, financial, regulatory, or professional advice of any kind. Any general information provided on the Platform regarding employment practices, labor law, immigration requirements, tax obligations, or related topics is provided for informational purposes only and does not constitute advice tailored to any individual's or organization's specific circumstances.
Users should not rely on Platform content as a substitute for obtaining qualified professional advice from a licensed attorney, employment specialist, tax advisor, or other relevant professional. The Company accepts no liability for any decisions made or actions taken in reliance on general information published on the Platform.
9. Employment Law Compliance
Employers are solely responsible for ensuring that their job listings, hiring practices, and any employment or engagement resulting from the use of the Platform comply with all applicable employment laws, labor regulations, anti-discrimination requirements, immigration laws, and tax obligations in the relevant jurisdiction.
The Company does not provide legal compliance advice to Employers and does not review listings for compliance with the specific employment laws of any jurisdiction. The presence of a listing on the Platform does not indicate that the listing complies with applicable law. Employers who are uncertain about their legal obligations should seek qualified legal advice before publishing listings or making hiring decisions.
Candidates should be aware that employment laws vary significantly between jurisdictions and that the Company cannot advise on the legal validity or enforceability of any employment terms offered through the Platform.
10. Limitation of Liability
To the maximum extent permitted by applicable law, the Company, its members, managers, officers, employees, agents, licensors, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with:
- Any reliance on the accuracy or completeness of any job listing or candidate profile on the Platform
- Any failure to obtain employment, fill a vacancy, or achieve any particular outcome through the use of the Platform
- Any employment dispute, discrimination claim, breach of contract, or regulatory action arising from an employment relationship initiated through the Platform
- Any loss arising from interaction with a fraudulent, misleading, or non-compliant Employer or Candidate
- Any interruption, suspension, or termination of access to the Platform
- Any reliance on third-party content or external links accessible from the Platform
- Any unauthorized access to or use of User data, to the extent attributable to User error or to factors outside the Company's reasonable control
This limitation applies regardless of the legal theory under which the claim is brought, whether in contract, tort, negligence, strict liability, or otherwise, and regardless of whether the Company has been advised of the possibility of such damages.
Some jurisdictions do not permit the exclusion or limitation of certain types of damages. In such jurisdictions, the above limitations apply to the fullest extent permitted by law and do not exclude any rights to which you are entitled as a matter of applicable mandatory consumer protection law.
11. Indemnification
By using the Platform, you agree to indemnify and hold harmless Avenor Holdings LLC and its members, managers, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the Platform in violation of these terms or applicable law
- Any content you submit to the Platform that proves to be false, inaccurate, or misleading
- Any employment dispute or regulatory action arising from actions you take or fail to take as an Employer or Candidate in connection with the Platform
- Your reliance on Platform content or third-party content accessible through the Platform
12. Jurisdictional Considerations
The Platform is operated from the United States and is intended to serve Users globally, including in the European Union, the Western Balkans, and other international markets. The Company makes no representation that the Platform or its content is appropriate or legally compliant for use in all jurisdictions.
Users who access the Platform from outside the United States do so on their own initiative and are responsible for compliance with applicable local laws. The Company does not warrant that the Platform complies with the laws of any specific jurisdiction outside the United States, though it endeavors to meet applicable requirements including GDPR in the European Union.
Nothing in this Disclaimer limits or excludes rights available to consumers under the mandatory laws of their country of residence, including consumer protection laws in the European Union.
13. Changes to This Disclaimer
The Company reserves the right to modify this Disclaimer at any time. Material changes will be posted on the Platform with an updated Effective Date. Continued use of the Platform after a modification takes effect constitutes acceptance of the revised Disclaimer.
