Terms governing refund requests, subscription cancellations, and statutory withdrawal rights for paid Employer services. The Platform is free for Candidates, so this Policy applies only to paying Employer accounts.
This Refund and Cancellation Policy ("Policy") governs all requests for refunds, cancellations, and subscription modifications made by Employers and other paying Users of the Hab Jobs platform at https://www.habposlovi.com/ ("Platform"), operated by Avenor Holdings LLC ("Company", "we", "us", "our").
This Policy applies exclusively to paid services purchased through the Platform, including job listing credits, subscription plans, and any other employer-facing paid features. The Platform is free for Candidates and no payment is collected from Candidates; accordingly, this Policy does not apply to Candidate accounts.
This Policy is incorporated into the Employer Terms and Conditions and the general Terms of Service. In the event of a conflict between this Policy and those documents, this Policy governs with respect to refund and cancellation matters.
We encourage you to read this Policy carefully before purchasing any paid service. By completing a purchase on the Platform, you confirm that you have read, understood, and agree to the terms of this Policy.
1. Products and Services Covered
This Policy applies to the following paid products and services available on the Platform:
1.1 Individual Job Listing Credits
A single-use credit that allows an Employer to publish one job listing for a period of 30 calendar days. Listing credits are purchased on a per-listing basis and are non-transferable between accounts.
1.2 Subscription Plans
Recurring plans that provide an Employer with a monthly or annual allocation of listing credits, enhanced Platform features, and any additional entitlements described in the relevant plan. Subscriptions are billed on a recurring basis and renew automatically unless cancelled in accordance with this Policy.
1.3 Listing Extensions and Upgrades
Optional paid add-ons that extend the duration of an active listing beyond its standard 30-day period, or that upgrade a listing's visibility or placement on the Platform.
1.4 Future Products
Any additional paid services introduced by the Company after the Effective Date of this Policy will be subject to the terms of this Policy unless a separate refund policy is explicitly specified at the point of sale.
2. General Refund Principles
The Company operates on a no-refund basis for commenced services, consistent with standard industry practice for digital marketplace services. The following general principles apply:
- Fees paid for a listing period or subscription cycle that has commenced are non-refundable, except in the specific circumstances described in Sections 3 and 4 of this Policy.
- The commencement of a listing period occurs at the moment a job listing is published and made visible on the Platform, regardless of the number of applications received.
- The commencement of a subscription cycle occurs at the moment of successful payment processing, regardless of whether the Employer has used any features or listing credits during that cycle.
- The Company does not issue partial refunds for unused days within an active listing period or for unused listing credits within a subscription cycle, except where expressly stated in this Policy.
- All refunds, where approved, are issued to the original payment method used at the time of purchase. The Company does not issue refunds in cash, by bank transfer to a different account, or in the form of credits to a third-party account.
- Refunds are processed in US Dollars. The Company is not responsible for any currency conversion losses or bank fees incurred by the recipient.
3. Refund Eligibility — Individual Listing Credits
3.1 Standard Eligibility
A refund for an individual listing credit may be approved in the following circumstances:
- The listing credit was purchased but has not yet been redeemed to publish a listing, and the refund request is submitted within 14 calendar days of the original purchase date.
- The listing was published but was removed by the Company within 48 hours of publication due to a technical error on the Company's part that rendered the listing inaccessible to candidates, and the Employer has not received any applications during that period.
3.2 Ineligibility
A refund for an individual listing credit will not be approved in the following circumstances:
- The listing has been live and accessible to candidates for 48 hours or more, regardless of the number of applications received.
- The listing was removed by the Company due to a violation of the Employer Terms and Conditions, the Acceptable Use Policy, or applicable law.
- The Employer voluntarily removed or archived the listing before its expiry.
- The refund request is submitted more than 14 calendar days after the original purchase date for an unredeemed credit.
- The Employer claims dissatisfaction with the volume or quality of applications received, as the Company cannot guarantee application outcomes.
4. Refund Eligibility — Subscription Plans
4.1 Pre-Commencement Cancellation
If you cancel a subscription plan before the first billing cycle commences — meaning before the first payment has been processed — no charge will be applied and no refund is necessary.
4.2 Cancellation After Commencement — Monthly Subscriptions
Monthly subscription fees are non-refundable once a billing cycle has commenced. If you cancel a monthly subscription after a billing cycle has commenced, your access to subscription features will continue until the end of the current billing cycle, after which the subscription will not renew. No refund of the current month's fee will be issued.
4.3 Cancellation After Commencement — Annual Subscriptions
Annual subscription fees are generally non-refundable once the annual billing cycle has commenced. However, the Company will consider a pro-rata refund of unused months in the following specific circumstances:
- The Employer cancels within 7 calendar days of the annual renewal date and has not used any listing credits or accessed premium features during that renewed cycle. In this case, a full refund of the renewed annual fee may be issued at the Company's discretion.
- The Company materially reduces the features or entitlements included in the Employer's subscription plan during an active annual cycle without providing reasonable prior notice or a commensurate price reduction. In this case, the Employer may request a pro-rata refund for the remaining unused period.
Pro-rata refunds for annual subscriptions are calculated based on complete unused calendar months remaining in the billing cycle at the time of the approved cancellation. Partial months are not refunded.
4.4 Unused Listing Credits Within a Subscription
Unused listing credits that expire at the end of a subscription cycle are not eligible for a refund. Listing credits are allocated per billing cycle and do not carry forward to subsequent cycles unless the relevant plan description explicitly states otherwise.
4.5 Free Trial Periods
Where the Company offers a free trial period prior to the commencement of a paid subscription, no charge is applied during the trial period. If you do not cancel before the trial period ends, the subscription will convert to a paid plan and the standard refund terms described in this Section will apply.
5. Refunds Due to Service Failure
5.1 Platform Unavailability
If the Platform experiences unplanned downtime or technical failure that renders a paid listing inaccessible to candidates for a continuous period of 24 hours or more during the active listing period, the Employer may request a credit or extension equal to the number of days during which the listing was inaccessible. Service credits will be applied to the Employer's account for use on future listings and are not issued as monetary refunds unless the Employer's account has been terminated and the credit cannot be applied.
Planned maintenance, scheduled downtime communicated in advance, or performance degradation that does not fully prevent access to the listing does not qualify for a service credit.
5.2 Payment Processing Errors
If a payment processing error results in a duplicate charge, the Company will issue a full refund of the duplicate amount within 10 business days of confirming the error. Refund requests for duplicate charges must be submitted within 60 calendar days of the charge date.
5.3 Unauthorized Charges
If you believe a charge has been made to your account without your authorization, you must notify the Company immediately at info@habposlovi.com. The Company will investigate the report and, where unauthorized access is confirmed, will work with you to resolve the issue including issuing a refund where appropriate. You are strongly encouraged to contact the Company before initiating a chargeback with your bank or card issuer, as chargebacks may delay resolution and may result in account suspension pending investigation.
6. EU and EEA Statutory Withdrawal Rights
If you are a consumer located in the European Union or the European Economic Area, you may have a statutory right of withdrawal under applicable consumer protection law, including the EU Consumer Rights Directive (2011/83/EU), allowing you to withdraw from a distance contract within 14 calendar days of the contract being concluded without giving any reason (the "Cooling-Off Period").
However, by expressly requesting that the Company begin providing the service before the end of the Cooling-Off Period — which occurs when you publish a job listing or otherwise activate a paid feature — you acknowledge that you waive your right of withdrawal to the extent the service has been performed. This acknowledgment is presented at the time of purchase and recorded by the Company.
If you have not activated any paid feature and have not requested early commencement of the service, you may exercise your right of withdrawal within 14 calendar days of purchase by contacting info@habposlovi.com with a clear statement of your withdrawal. In such cases, the Company will issue a full refund within 14 calendar days of receiving your withdrawal request.
Nothing in this Policy limits or excludes any rights that cannot be waived or excluded under applicable EU consumer law. If you are uncertain about your rights as an EU consumer, you may seek guidance from the consumer protection authority in your country of residence.
7. Subscription Cancellation Procedure
7.1 How to Cancel
To cancel a subscription, you must take one of the following steps before the next renewal date:
- Cancel directly through your Employer account dashboard using the subscription management feature, if available
- Send a written cancellation request to info@habposlovi.com from the email address registered to your account, including your account name and the subscription you wish to cancel
Cancellation requests sent by any other means, including through social media or third-party platforms, will not be accepted.
7.2 Cancellation Timing
Cancellations must be submitted before the renewal date to take effect for the upcoming billing cycle. The Company recommends submitting cancellation requests at least 3 business days before the renewal date to allow for processing time.
Cancellation requests submitted after a renewal payment has been processed will take effect at the end of the newly commenced billing cycle. No refund will be issued for the cycle in which the cancellation request is received after renewal, except in the circumstances described in Section 4.3.
7.3 Confirmation of Cancellation
Upon successful processing of a cancellation, the Company will send a confirmation email to the registered account email address. If you do not receive a confirmation within 3 business days of submitting your cancellation request, you should contact info@habposlovi.com to confirm the status of your request. The absence of a confirmation email does not constitute evidence that a cancellation request was received or processed.
7.4 Effect of Cancellation
Upon cancellation of a subscription:
- Your access to subscription features will continue until the end of the current billing cycle
- Active job listings published under the subscription will remain live until their individual 30-day listing periods expire, unless you choose to remove them earlier
- Unused listing credits allocated to the current billing cycle will expire at the end of that cycle and will not be refunded or carried forward
- Your Employer account will revert to a free-tier or inactive status following the end of the billing cycle
8. Refund Request Procedure
8.1 How to Submit a Refund Request
To submit a refund request, please contact the Company by email at info@habposlovi.com with the subject line "Refund Request". Your request must include:
- The full name and email address registered to your Employer account
- The date and amount of the transaction for which a refund is requested
- A clear description of the reason for the refund request
- Any supporting information or documentation relevant to your request
8.2 Processing Timeframes
The Company will acknowledge receipt of your refund request within 3 business days. A decision on eligibility will be communicated within 10 business days of receipt of a complete request. Where additional information is required, the 10-business-day period begins from the date that the complete information is received.
Approved refunds will be processed to the original payment method within 10 business days of approval. Depending on your bank or card issuer, it may take an additional 5 to 10 business days for the refunded amount to appear in your account. The Company is not responsible for delays caused by financial institutions.
8.3 Disputes and Chargebacks
If you are dissatisfied with the outcome of a refund request, you may escalate your concern by replying to the Company's decision email and requesting a senior review. The Company will complete a senior review within 15 business days.
You are strongly encouraged to exhaust the Company's internal refund process before initiating a chargeback with your card issuer or bank. Initiating a chargeback without first contacting the Company and completing the internal process constitutes a breach of the Employer Terms and Conditions and may result in immediate account suspension, recovery of costs associated with the chargeback, and possible legal action.
9. Account Termination and Refunds
9.1 Termination by the Employer
If you choose to close your Employer account, any active subscription will be treated as a cancellation in accordance with Section 7. Unused listing credits and remaining subscription periods are forfeited upon account closure and are not eligible for a refund, except in the specific circumstances described in this Policy.
9.2 Termination by the Company for Cause
If the Company terminates your Employer account due to a violation of the Employer Terms and Conditions, the Acceptable Use Policy, or applicable law, no refund will be issued for any prepaid fees, including active subscription periods or unused listing credits. This applies regardless of when in the billing cycle the termination occurs.
9.3 Termination by the Company Without Cause
If the Company terminates your Employer account without cause and with less than 14 calendar days' notice, it will issue a pro-rata refund for the unused portion of any active prepaid subscription period, calculated on a daily basis from the date of termination to the end of the current billing cycle.
10. Modifications to This Policy
The Company reserves the right to modify this Refund and Cancellation Policy at any time. When material changes are made, the Company will post the updated Policy on the Platform with a revised Effective Date and notify registered Employer accounts by email. Changes apply to purchases made after the effective date of the revision. Purchases made before a policy change are governed by the version of the Policy in effect at the time of purchase.
